In March 2010, Gary Weber defended the case of Phillips vs. Tomedi, a case filed in the Court of Common Pleas of Centre County. The jury heard the case, involving claimed injuries from a rear-ending accident in State College.
The plaintiff was insured under a limited tort insurance policy. The defendant admitted negligence. The only issues for the jury were the cause of the claimed injuries, whether the accident related issues were "serious" enough to overcome the limited tort threshold and what damages to award.
Injuries claimed included migraine headaches, severe back and neck pain and shoulder pain that resulted in surgery. Plaintiff was off work for 8 months.
The jury found that the head and back problems from the accident were minimal, and did not relate the shoulder problems to the accident. Plaintiff was awarded wage loss of $1048 and $299 in incidental expenses. Her injuries were not found to be serious, and no non-economic damages were awarded.
